Terms of Service (TOS)

The following terms of Service (below: "TOS") exclusively apply to the
Service available at http://navig8.to. This Service is provided by
Thomas Wolf & Jöran Beel (below: "N8.2"). The TOS may
be updated by us from time to time without notice to you. The most current
version can be reviewed at any time at: http://navig8.to/tos.php.
- Description of Service
N8.2 provides a free of charge redirection and subdomain service
available at http://navig8.to. This Service consists of short
URLs in the form of subdomains or virtual directories that redirect
to existing internet addresses. Users that signed up for this Service
are able to adjust their short URL settings, and thus the redirects
created by them, to their needs. Users that signed up for this Service
are not able to provide data or publish content via this Service which
exclusively provides redirects to existing data or already published
content available through existing internet addresses only. The Service
provided by N8.2 could be compared to ToNIC where domains can
be registered which then redirect to existing IP addresses.
- Availability
N8.2 will try to provide its service 24/7. However it is not
guaranteed that the service will be available at any time.
- Costs and Termination
This Service is provided free of charge. Membership can be cancelled
at any time and without previous notice. N8.2 may at any time
and for any reason discontinue providing the service or any part of
it, with or without notice.
You agree that N8.2 may terminate your account (or any part
of it), remove, and discard any data connected to the account for any
reason, especially if N8.2 believes that you have violated
the TOS.
- User Obligations and Rights
You understand that you are responsible for all content (i.e. text,
information, pictures, sound, music, video and all other materials)
that you upload or make available to or via the Service. This particularly
means that you, but not N8.2, are responsible for any content
that is available at or via your account's short URL, even if you did
not upload or provide the data yourself and even if you did not know,
that the content was available at or via your account's short URL.
You agree to indemnify N8.2 from any claims of any third party
that arise due to your responsibility of content as stated above.
You agree not to upload or make available any content that might be
unlawful in Austria, Germany, or your home country or that is objectionable
or may be considered as objectionable, including, but not limited to,
pornographic, pedophile, racist, and Nazi content.
You agree not to send spam emails and not to spam
message boards, newsgroups or the like by using or referring to the
Service provided by N8.2.
You agree to provide true, accurate, current, and
complete information about yourself.
You are responsible for maintaining the confidentiality of the password
and account, and are fully responsible for all activities that occur
under your password or account. You are obliged to contact N8.2
immediately, if know or believe that your password or account information
may be available to someone else.
- Advertisements
You accept advertisements (such as, but not limited to, popup windows
and banner frames) to be displayed on your website, for example when
your short URL is accessed by visitors. Furthermore you agree to receive
regular emails from N8.2 that might also contain advertisements.
- Privacy Policy
N8.2 saves your personal information and merely uses it for
internal purposes. N8.2 will only share your personal information
on your explicit agreement or due to legislation requirements.
However, you have to be aware that certain personal information is available
to the public through the “Whois” feature.
All of your personal information is stored on a server connected to
the internet. N8.2 therefore cannot guarantee with absolute
certainty that only authorized persons obtain access to your personal
information.
- Indemnity
You agree to indemnify and hold N8.2 harmless from any
claim or demand, including reasonable attorneys' fees, made by any third
party due to or arising out of content you submit, post, transmit or
make available through N8.2, your use of the Service, your
connection to Service, your violation of the TOS, or your violation
of any rights of another. You use our Service at your own risk. N8.2
is only liable in case of gross negligence or intent.
- General Information
These TOS apply to all users. Individual changes must be in written
form.
N8.2 reserves the right to change the TOS at any time. Within
seven workdays, N8.2 will send you an email informing you about
the changes. The email will be sent to the address that you have specified
during the registration for the Service. You accept the changes, if
you don’t enter an objection within four weeks.
The TOS remain valid, even if one ore more of the clauses or sentences
in the TOS should be or become inoperative or not applicable. The invalid
or inoperative clause shall be replaced by a valid clause with similar
economic result.
